Divorce - "Making the Impossible Possible"









The other day, my client told me that there was no way he could have handled his divorce without me. While I appreciate the compliment, it gets at a much deeper issue of how complex a divorce can be on so many levels.


I used to represent individuals charged with serious violent felony charges on a regular basis. I have been in jury trials that have lasted for weeks, fighting for my client's right to live their life outside of a cage. Believe it or not, handling a divorce is just as intense.


My son asked me the other day why I thought handing a divorce was just as intricate and important as handling a case where a person's very life is at stake. I told him this: "Our life is what we create. It is our experiences and our joys and our family and our memories." I told my son, "Imagine someone told you that you have to figure out a way to divide up your life. You have to divide up all of your toys fairly. Now, add the family dog. How do you divide time with the family dog fairly? How do you decide who gets the baseball cards your grandfather gave to you? How do you take all of the money in your piggy bank and divide it with another person? How do you take the pictures off of your walls and decide who gets what?" He looked at me with the earnestness of a child and said, "That's impossible and it's unfair."


It may be unfair. Some of our laws regarding child custody and alimony are, in my humble opinion, unfair. But, it's not impossible. What is impossible is to handle it on your own. Not only is there the law and the rules and the procedures and the forms... there's also the very real impossibility of imagining what this division would look like. It is impossible to predict what a judge will do without a lawyer to guide you. It is impossible to know what the law says unless you've studied it.
